These Terms of Use (the “Terms”) govern your access to and use of Ball’s websites, mobile and web applications, widgets, and related services (collectively, the “Service”). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1) Eligibility
- You must be at least 18 years old (or the age of majority where you live, if higher).
- You may not use the Service if you are prohibited by applicable law, including any law restricting participation in sports prediction, contests, or gaming-related activities.
- If you access the Service on behalf of an organization, you represent that you are authorized to accept these Terms for that organization.
2) Accounts & Security
- Provide accurate information and keep your credentials secure. You are responsible for all activity under your account.
- One natural person = one account. You may not create multiple accounts to gain an advantage in predictions or leaderboards.
- We may suspend or terminate accounts that violate these Terms or our policies, or that appear compromised or fraudulent.
3) Features: Fixtures, Insights, Predictions & Leaderboards
3.1 Fixtures & Schedules
Upcoming fixtures, kickoff times, and schedules are provided for convenience and may change without notice. Check official league sources for the most current information.
3.2 AI Insights & Probabilities
- Our models may display headline probabilities (e.g., Home/Draw/Away). These are estimates only and may be incomplete, incorrect, delayed, or based on limited or third‑party data.
- Insights are provided for informational and entertainment purposes and are not betting, financial, or legal advice. You assume full responsibility for how you use this information.
3.3 Predictions
- You may submit match predictions (e.g., W‑D‑L or exact score) for fun and friendly competition. Predictions are locked before kickoff and cannot be edited after the lock time.
- You agree not to collude, automate submissions, or exploit timing to gain unfair advantage.
- We may disqualify, delete, or adjust predictions that we reasonably believe are invalid, late, abusive, or the result of technical manipulation.
3.4 Leaderboards & Rolling Form
- Leaderboards may show 7‑day, 30‑day, and all‑time standings. The calculations and scoring logic are determined by Ball and may change at any time.
- Ties, disputes, and suspected abuse may be resolved by us in our reasonable discretion, including removal of entries or accounts.
- Leaderboards are for entertainment only; they convey no cash value, prizes, or rights unless expressly stated.
3.5 My Team
Following a club personalizes your feed. Availability and data coverage may vary by league or region.
4) Acceptable Use
- No illegal activity, harassment, hate speech, or infringement of others’ rights.
- No scraping, bulk extraction, or use of bots without our prior written permission.
- No reverse engineering, circumventing security or lock times, or interfering with the Service’s normal operation.
- No cheating, multi‑accounting, or collusion to manipulate leaderboards or predictions.
- No unauthorized use of league, team, or player marks, and no implying endorsement where none exists.
5) User Content & License
You retain ownership of content you submit (e.g., picks, comments, profile data). You grant Ball a worldwide, non‑exclusive, royalty‑free license to host, store, display, and use that content to operate and improve the Service. You are responsible for the legality of your content.
6) Intellectual Property
- The Service, including software, designs, and the Ball brand, is protected by intellectual property laws. Except as permitted by these Terms, you may not copy, modify, or redistribute any part of the Service.
- Third‑party names, logos, and marks are the property of their respective owners and used for identification purposes only. We are not affiliated with or endorsed by any league or club unless explicitly stated.
7) Third‑Party Data, Links & Integrations
The Service may reference or link to third‑party content, services, or data feeds. We do not control and are not responsible for third‑party materials. Your use of third‑party services may be subject to separate terms and privacy policies.
8) No Betting or Financial Advice
Ball is not a sportsbook, tipster, or financial advisor. The Service does not offer or facilitate wagers, and nothing on the Service should be construed as an inducement or instruction to gamble. If you choose to place bets with third parties, you do so at your own risk and must comply with all applicable laws and responsible‑gaming guidelines.
9) Privacy
Please review our Privacy Policy to understand how we collect and use information. By using the Service, you consent to our data practices as described there.
10) Communications & Notifications
We may send you service announcements, security alerts, and administrative messages. Where required, we will obtain your consent for marketing communications, and you can opt out as provided in those messages.
11) Subscriptions & Payments (if applicable)
- We may offer paid plans or in‑app purchases. Prices and features may change. Taxes may apply.
- Unless stated otherwise, charges are non‑refundable once the billing period begins. Your statutory rights are unaffected where applicable law provides otherwise.
- You may cancel at any time through your account settings or app store; access continues until the end of the paid period.
12) Service Changes & Availability
We may add, change, or remove features and may suspend or discontinue the Service in whole or in part. We will attempt to provide reasonable notice of material changes where practicable.
13) Disclaimers
- The Service is provided on an “as is” and “as available” basis, without warranties of any kind.
- We do not warrant that probabilities, predictions, schedules, or other outputs will be accurate, complete, or timely.
- We do not guarantee uninterrupted or error‑free operation or that the Service is free of harmful components.
14) Limitation of Liability
To the maximum extent permitted by law, Ball and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses, arising from or relating to your use of (or inability to use) the Service—even if we have been advised of the possibility of such damages. Our aggregate liability to you for all claims relating to the Service shall not exceed the greater of (a) the amounts you paid to Ball in the 12 months before the event giving rise to the claim or (b) USD $100.
15) Indemnification
You agree to defend, indemnify, and hold harmless Ball and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service or your violation of these Terms or applicable law.
16) Copyright Complaints
If you believe content on the Service infringes your copyright, please send a notice with sufficient detail to identify the material and your rights to Support. We will respond as required by applicable law (e.g., the U.S. DMCA where applicable).
17) Suspension & Termination
- You may stop using the Service at any time. You may request deletion of your account as described in our Privacy Policy.
- We may suspend or terminate access if we believe you have violated these Terms, pose a risk, or if we discontinue the Service.
- Upon termination, sections that by their nature should survive (e.g., licenses, disclaimers, limitations of liability) will survive.
18) Governing Law & Dispute Resolution
These Terms and any dispute arising out of or relating to them or the Service will be governed by the laws of your place of residence if required by mandatory consumer protection laws. Otherwise, they will be governed by the laws of the jurisdiction where Ball is established, without regard to conflict‑of‑laws rules. You and Ball submit to the exclusive jurisdiction of the courts located in that jurisdiction, except where applicable law allows you to bring claims in your local courts.
19) Consumer Rights
Nothing in these Terms affects any non‑waivable statutory rights you may have under applicable consumer protection laws.
20) Miscellaneous
- Entire Agreement. These Terms (and any policies referenced here, like the Privacy Policy) are the entire agreement between you and Ball regarding the Service.
- Changes to These Terms. We may update these Terms from time to time. Changes are effective upon posting. If changes are material, we will provide additional notice (e.g., banner or email where feasible).
- Assignment. You may not assign these Terms without our consent. We may assign them to an affiliate or in connection with a merger, acquisition, or asset sale.
- Severability. If any provision is unenforceable, the remaining provisions remain in effect.
- Waiver. Failure to enforce a provision is not a waiver of the right to enforce it later.
- Headings. Headings are for convenience and do not affect interpretation.
- Language. We may provide translations; the English version controls in the event of conflict.
